Your Holiday Contract
When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. A contract will exist as soon as we issue our confirmation invoice. This contract is made on the terms of these booking conditions, which are governed by Indian Law, and the jurisdiction of the Indian Courts. If you had not seen these terms and conditions when you made your booking and you are not happy to proceed with the booking now that you have seen them please return all documentation to us or to your travel agent, within 7 days of receiving these booking conditions. Your booking will be cancelled and your monies will be returned in full, provided you have not commenced your travel. This clause does not apply if your booking was made within 8 weeks of travel.
You can call our office on + 91 11 45649371 between 10.00 am and 6.30pm Monday to Friday to discuss your plans. Upon receipt of your enquiry we will provide you with a full written quotation together with our suggestions and recommendations. This quotation will state clearly 'What Is Included' in the price and 'What is Extra'. Once you have accepted the written quotation we will require you to complete a Booking Form and send it to us. The following deposits will be required and may be paid by cheque, bank transfer or credit / debit card, over the phone if more convenient. On receipt of the deposit, KDH Travels Pvt Ltd will proceed to confirm all the arrangements and send you within 21 days our confirmation together with a complete itinerary. We will require the balance to be paid eight weeks before your departure.
All payments will be accepted by Payee Account Cheques/ Pay Orders/ D.D only. Only under special circumstances Cash will be accepted & that too only in the office against official receipt. Please ensure that the cheques are timely delivered to our office for encashment since no documents would be delivered till the cheques are en-cashed. This would save you from inconvenience of making payments by Pay Order/ D.D. Please note that Cheque Bouncing Charges will be Rs 500/-.
Cancellation by you
Should you wish to cancel your holiday, you must notify your travel agent or KDH Travels Pvt Ltd directly in writing as soon as possible. Please advise the reason for cancellation as you may be covered by your insurance policy. If notification of cancellation is received more than 57 days before departure only your deposit will be forfeit, within eight weeks the following cancellation charges will be applied:
- 40% of final invoice
- 60% of final invoice
- 80% of final invoice
- 100% of final invoice
Cancellation by us
Normally we will not cancel your holiday except if events occur which make it impossible to operate to an acceptable level of safety, convenience and comfort, such as political unrest, hostilities, industrial disputes, strikes, riots or civil commotion, natural disaster or any other similar circumstances or if you have not paid in full by eight weeks before departure. All group departures are subject to a minimum number of passengers, the tour is reviewed at 8 weeks prior to departure which is the latest date when the tour might be cancelled on account of low numbers. If we have to cancel a tour you will be offered an alternative tour or a full refund.
We reserve the right to cancel your holiday any time during its operation if you are found to be behaving in a socially unacceptable manner or indulging in an illegal activity. In such cases no refund will be offered for the unutilised portion of the holiday and KDH Travels Pvt Ltd will further claim from you the costs of your return to the parent country.
Delay on Departure
KDH Travels Pvt Ltd only book clients to travel by scheduled airlines and in the event of a departure being delayed, after you have checked-in, your welfare will be the responsibility of the airline involved.
In case of any Flight Cancellation Before Departure/After Departure same Cancellation policy apply for Hotel and Land Part and Refund of Flight Part will depend upon receipt of refund from Airline &KDH Travels Pvt Ltd does not have and liability for Same.
Passport, Visa and Immigration Requirements
It is imperative that the surname and initials on your passport corresponds exactly with the surname and initials you have given KDH Travels Pvt Ltd to be printed on any airline tickets. Failure to do so may result in the airline refusing you the right to travel. Your specific passport and visa requirements and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and / or Consulates. We do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. Please check your passport and visa validity, our company has no responsibility for same, it’s embassy decision to approve your visa and in case of visa rejection cancellation charges will apply.
If You Have a Complaint
If you have a problem during your holiday, please inform the relevant supplier (e.g. your hotelier) and our local representative immediately who will endeavour to put things right. If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to us . It is strongly recommended that you communicate any complaint to the supplier of the services in question as well as to our representative whilst in resort so that we have the opportunity to investigate and rectify your complaint whilst you were in resort.
Pre-existing medical conditions / Disabled passengers
It is essential that you advise us before booking if you have any disability, pre-existing medical conditions or important dietary requirement that KDH Travels Pvt Ltd should be made aware of before we accept responsibility for operating this itinerary to the countries named. We may request that you provide a letter from your doctor confirming your fitness to travel.
Alterations by you
Once we have agreed an itinerary with you, and issued a confirmation and account, should you wish to change your itinerary, we will arrange this if possible, and adjust the price of your holiday accordingly. we will advise you of any cancellation/amendment charges levied by them and these will also be charged to you. Note: Certain travel arrangements may not be changeable after a reservation has been made and any alteration request could incur a cancellation charge of up to 100% of that part of the arrangements.
Alterations by us
From time to time it may be necessary or advisable to alter the arrangements for your holiday. We reserve the right to make such alterations to any of the arrangements, as we consider necessary or advisable.
Our Liability to You
If the contract we have with you is not performed or is improperly performed by us or our suppliers we will pay you appropriate compensation if this has affected the enjoyment of your travel arrangements. However we will not be liable where any failure in the performance of the contract is due to: you; or a third party unconnected with the provision of the travel arrangements and where the failure is unforeseeable or unavoidable; or unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or an event which we or our suppliers, even with all due care, could not foresee or forestall. Our liability, except in cases involving death, injury or illness, shall be limited to a maximum to the cost of your travel arrangements.
General Conditions –
Please verify time from the Hotel or Guide regarding – Meal, Sightseeing timing & strictly adhere to same to avoid the privilege and should report to lobby for transfers, city tour strictly at the designated time. In case of delay, the same will be missed and we shall bear no responsible to the same and no refund on account the same will be entertained.
Any Hike (due to Government policies) in hotel rates, Airfare, Airport Tax or Fuel will attract a Surcharge to be paid prior the departure date.
The offer is subject to RBI/GOI Regulations and Dollar segment, which will be taken out of your BTQ (Basic Travel Quota).
